Statement regarding issues with the TGSS and the SEPE
We would like to draw your attention to several incidents which we have identified are occurring in connection with various procedures that have been carried out with the TGSS and SEPE.
These issues stem from inefficiencies and errors being made by both organisations, which we assume are the result of the large number of requests and administrative procedures arising from the current situation, the ERTEs that have been processed, and the changing circumstances and regulations. In any case, these issues have nothing to do with the management of AURIS ADVOCATS or with your own management, and are beyond our control.
We thought it would be useful for you to be aware of the most common issues and how to resolve them, so that you can respond more quickly and efficiently and put your staff’s minds at ease:
– Self-employed contributions: The April instalment, which according to the Royal Decree was not to be debited from the accounts of self-employed workers, has been debited from the accounts of some self-employed workers but not others. This is due to an error on the part of the authorities, depending on the province and/or office of TGSS.
After consulting the authorities, they have confirmed that no action is required and that the payment will be refunded automatically, just as with the March instalment. Therefore, if this applies to you, please keep an eye out for the refund of these charges. Should the refund not be issued, you will need to submit a claim for a refund.
– Unemployment benefits for workers on ERTE: The SEPE is making payments for March and April to some workers; to others, only the pro rata portion for March; whilst others have not yet received any payment. In many cases, workers can see via their profile that they are on ERTE leave, whilst the information and certificates we have submitted from the company show them as active, and this is how it is recorded in the SEPE in the certificates we access via this public employment portal (certific@2).
Employees can make enquiries by calling 900 81 24 00 or via this link: http://www.sepe.es/HomeSepe/contacto/Atenciononline.html They can view their own file and access a specific form for making more detailed enquiries – the “enquiry form”. As this is a personalised process, we recommend that the employee themselves send an email via the link provided.
In general, it should be noted that there are a great many incidents occurring within the Administration, without data being standardised between the SEPE and TGSS, so the situation is a right mess.
We believe it is important to issue this statement, firstly, to show that this is a widespread situation, not attributable to any shortcomings in our own management, and, secondly, to be able to provide appropriate information to employees and the self-employed who find themselves in the situations described.
In any case, the Team at AURIS LAWYERS I am at your disposal should you have any queries or require any clarification regarding the above.
